Commercial Terms of Service

1. Scope

These terms apply to commercial trials, paid subscriptions, enterprise deployments, support, security review, and related PHI Mask services.

If your organization has a separate written agreement, order form, data processing agreement, or security addendum with PHIMask.com, that written agreement controls where it says something different from these public terms.

2. Access and administration

You are responsible for the people and systems that use PHI Mask under your account, license, invite, install link, or organization identifier. You must keep credentials and license material confidential and notify us promptly about suspected misuse.

You may use PHI Mask only for lawful business purposes and only within the seats, workloads, environments, and usage limits in your order, invite, or written agreement. You are also responsible for export-control, sanctions, procurement, model-provider, and workplace-policy compliance that applies to your use.

3. License and restrictions

• A new user's free evaluation lasts 14 days beginning with their first successful mask.
• After the evaluation, masking continues under Free Personal. Free Personal is not licensed for commercial use.
• An evaluation does not by itself authorize real sensitive-data use; follow your organization's policies and any required agreement.
• Ongoing commercial use requires a commercial license from PHIMask.com. This includes continued use for work, clients, company systems, revenue, production, procurement, or organization administration after evaluation.
• PHIMask.com grants you a limited, non-exclusive, non-transferable right to install, access, and use PHI Mask for your internal business use during the applicable term.
• You may not resell, sublicense, host PHI Mask for third parties, remove notices, bypass licensing or abuse-prevention controls, or use PHI Mask to violate law, model-provider terms, or third-party rights.
• You may not reverse engineer proprietary components except where applicable law allows that right despite this restriction.
• PHI Mask's masking work is patent pending.

4. Customer data

The Data Usage Policy and Privacy Policy explain what the PHI Mask browser masker, public free-use meter, contact forms, security reports, site analytics, and hosting logs may process, and what PHIMask.com does not collect from masking.

You are responsible for configuring PHI Mask and any downstream model providers for your required privacy, retention, compliance, model-provider, and deployment controls. Enterprise customers may set different privacy, retention, or network terms in a written agreement.

5. Evaluation information

Any examples, demos, detection previews, or pilot findings are provided for product evaluation and operational planning. They are not legal, clinical, security, or compliance advice.

Actual commercial value depends on your workflows, document types, review processes, model-provider use, and deployment configuration. PHIMask.com does not promise a particular business outcome unless a signed order says so.

6. Fees, orders, and renewal

Commercial fees, billing period, renewal, cancellation, taxes, and payment terms are set in the applicable order, invoice, marketplace listing, or written agreement.

PHIMask.com may change or withdraw an evaluation offer for future users. An evaluation already begun keeps its 14-day term unless access is suspended for breach, abuse prevention, security, or legal compliance.

7. Support, availability, and changes

Support commitments, service levels, enterprise features, deployment assistance, and security commitments apply only when included in a written agreement or order.

PHIMask.com may update PHI Mask, documentation, data-use disclosures, and public terms to improve reliability, security, compatibility, or compliance. Material public-term changes are reflected by updating the effective date.

8. Confidentiality

Non-public product, security, pricing, roadmap, diagnostic, benchmark, and customer information exchanged during commercial evaluation or deployment must be kept confidential unless the disclosing party allows disclosure in writing.

9. Customer content, feedback, and indemnity

You keep your rights in customer content, prompts, files, code, reports, submissions, and business data. PHIMask.com keeps all rights in PHI Mask, phimask.com, documentation, software, designs, diagnostics, and aggregate product know-how.

Feedback may be used to improve PHI Mask without creating a payment obligation, but PHIMask.com does not use feedback, prompts, code, files, masked content, diagnostics, or customer content to train foundation models.

Unless a written agreement says otherwise, you are responsible for claims arising from your users, workloads, customer content, unlawful use, or breach of these terms.

10. Third-party services

PHI Mask may be used with third-party browsers, devices, model providers, storage systems, and infrastructure that PHIMask.com does not control. Your use of those services remains subject to their terms, pricing, policies, and availability.

11. Disclaimers and liability

Except for commitments in a signed agreement, PHI Mask and related services are provided as-is and as available, without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, or error-free operation.

To the fullest extent allowed by law, PHIMask.com is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost data, or business interruption. Any aggregate liability is limited to amounts paid for PHI Mask in the 12 months before the event giving rise to the claim, unless a written agreement says otherwise.

12. Suspension and termination

PHIMask.com may suspend or terminate access for non-payment, security risk, misuse, legal risk, or breach of these terms. After termination, you must stop using commercial builds and delete or return confidential material when requested.

Sections that by their nature should survive termination continue to apply, including confidentiality, payment obligations, restrictions, disclaimers, liability limits, and dispute terms.

13. Disputes, notices, and contact

Disputes, governing law, venue, notices, and procurement process are handled under any applicable written agreement. If no written agreement applies, contact us through the request form at https://phimask.com/#apply before relying on these public terms for procurement or production deployment.
